SERVICE DETAILS
CONTRACT TERMS:
Price is based on Website Online credit card, Zelle, Venmo, or Cash payment.
The Contract Price specified herein is for event planning services. A non-refundable reservation fee of $1250.00 is paid at the signing of this Contract, with the remaining payments due as described above under “Contract Terms.”
Client is responsible to reimburse Your Day Your Way for any and all miscellaneous costs, which we incur in providing you with goods and/or services related to the event/event under this Contract (i.e. hotels, rental cars, meals in transit, tolls, miles, parking, etc.) Your Day Your Way will inform Client of the estimated cost of miscellaneous expenses prior to the event. An invoice will be sent to Client at the end of each month, with payment due upon receipt. .
AREAS OF CONSULTATION:
Your Day Your Way will plan all areas of the event day for client, including Venue, Food, Décor, Photography, DJ, Cake, and events and schedule for the day. A Day of Coordinator will be assigned to manage your event day.
Client’s Obligation under this Contract:
Ø To sign all contracts with the individual vendors
Ø Pay the individual vendors direct
Ø Pay the Event Planner direct
Your Day Your Way takes our job very seriously and we are here to serve you with the utmost professionalism and integrity.
Life is not perfect and events/events always carry surprises and unexpected circumstances. Your Day Your Way will provide information, time, and advice to you to the best of our ability. However Client agrees to hold Your Day Your Way harmless in the unlikely event that any aspect of your event/event fails to completely satisfy you. “Day of” event planning/event services does not represent or infer any contractual obligation between the vendor/venues that the client reserves for their particular event/event and the event/event planer hired by the client. The client alone is responsible for the vendors/venues, goods and services, that they procure for their event/event.
Your Day Your Way is not responsible for the conduct and/or performance of any vendor or venue, even though Your Day Your Way may have referred or endorsed that vendor or venue to Client. It is the Client’s sole responsibility to hire, Contract with and pay all vendors and/or venues in a timely manner. It is agreed that Your Day Your Way is not acting as your legal advisor in negotiating and/or executing venue and/or vendor Contracts. Instead, we recommend that you seek qualified legal advice.
In the event of a breach for non-payment, Your Day Your Way has the right to cancel this Contract effective upon notice by email to Client. In the event of breach for non-payment, Your Day Your Way has the sole right to retain the fee collected for work done to date.
In the event of cancellation of this event/event by the Client or due to Acts of God such as earthquake, hurricane, tornado, flooding, or other natural disaster, or in the case of war, action of foreign enemies, terrorist activities, labor dispute or strike, government sanction,states of emergencies, blockage, embargo, or failure of
electrical service, and/or your request and/or cancellation of our goods and/or services, the total Contracted cost of this Contract is due in full. In the unlikely event of a dispute and/or legal action, our liability is strictly and completely limited. Any court action will take place before a Judge not a jury. If you fail to pay as per the term of this Contract, your past-due account will be charged at a rate of one and one-half (1 ½%) per month, compounded.
In the event the event needs to be postponed, Your Day Your Way will work with the Client to coordinate the event on the new date. However, there may be a rescheduling fee:
· If event is rescheduled within a year from the original event date, no additional fee is required.
· If event is reschedule within 1-1/2 years of the original event date, and additional 10% of the contract cost is required.
· If event is rescheduled after 1-1/2 years up two (2) years, an additional 25% of the contract cost is required.
· If event is reschedule after two (2) years, Your Day Your Way has the right to retain all the fees collected and a new contract and price will be necessary.
In the event that Your Day Your Way is not available on the new date, Your Day Your Way has the sole right to retain the fee collected for work done so far and lost business by holding the event date open for the previously contracted date of the event/event.
Client gives permission to Your Day Your Way to use photographs and/or video personally taken or provided by the hired photographer(s) and/or videographer(s) for marketing and testimonial purposes
Your Day Your Way will not accept payment to any vendor/venue from Client. It is the Client’s sole responsibility to pay all Contracted vendors/venues. Notwithstanding this, Your Day Your Way may be able to assist with providing final payment and/or tips to vendors/venue that are due on the date of the event/event.
All vendors accepted by the client shall be liable for their own business practices. The Event Planner will do everything reasonable to assure that any vendor referred and accepted by the client is reputable and reliable. If a specific vendor cannot perform, the Event Planner, under this agreement, will make an effort to find a satisfactory substitute as directed by the client or in the Event Planner’s best judgment.
No products/services, other than those included in the Contract, will be ordered or procured for you. If Client desires other products/services to achieve the fulfillment of the event/event, these other products/services are the Client’s sole responsibility, as is payment, Your Day Your Way is in no way responsible for any service/product procured or Contracted by the Client.
The parties’ performance under this Contract, in whole or in part, is subject to acts of God, war, government regulation, terrorism, disaster, strikes, civil disorder, curtailment of transportation facilities, or similar emergency beyond the parties’ control, making it impossible, illegal, or commercially inadvisable, or which materially affects a party’s ability to perform its obligations under this Contract.
Time is of the essence as is your performance and obligation herein. We reserve the right to cancel this Contract at any time, for any reason, prior to the event/event date, and will make a full refund of your booking fee deposit. If this Contract is enforced against you, you will pay all expenses incurred by Your Day Your Way including but not limited to attorney’s fees, filing fee, court costs, interest, consequential damages, etc.
This Contract is governed by the laws of the State of Maryland, Baltimore County. NOW THEREFORE, this Contract embodies the entire understanding of the parties and any modification of the Contract shall be made in writing.

COVID-19/PANDEMIC WAIVER
By agreeing to the following, you are acknowledging that an inherent risk of exposure to COVID-19 exists in any public place where people are present, including the event and/or event which you will be attending. You also acknowledge that although we will do our best to maintain all rules/guidelines imposed by state/local authorities, that those rules/guidelines may be violated at this event and/or event, through no fault of our own. By attending this event and/or event, you and any guests voluntarily assume all risks related to exposure to COVID-19 and agree not to hold Your Day Your Way LLC or Vision Me Mirror Photo Booth ; or any of their affiliates, referrals, directors, officers, employees, agents, contractors, or volunteers liable for any illness or fatality or injury.
